1. Service Description
LowerMyCommercialTax.com provides commercial property tax protest consulting services in the state of Texas. We assist property owners in filing protests with their respective county appraisal districts (CADs) to challenge assessed property valuations. Our services include case evaluation, evidence preparation, filing with the CAD, and representation at informal and formal hearings.
2. Contingency Fee Model
Our services are provided on a contingency basis:
- • Our fee is 30% of the first-year tax savings we achieve for your property
- • You pay nothing upfront — no retainer, no research fees, no filing fees
- • If we do not achieve a tax reduction, you owe us nothing
- • Fee is calculated on savings in the first year of the reduction only
- • You retain 100% of all future savings from years 2 onward
3. No Guarantee of Results
We cannot guarantee that your property will be successfully protested or that you will achieve any particular amount of tax savings. Outcomes depend on:
- • The strength of comparable sales and income data available for your property type and market
- • The CAD's assessment methodology and documentation
- • The appraisal review board's interpretation of evidence
- • Market conditions and property-specific circumstances
Each case is evaluated individually, and we will provide you with an honest assessment of case strength before you sign our representation agreement.
4. Client Responsibilities
As a client, you agree to:
- • Provide accurate, complete information about your property and business operations
- • Respond to our requests for information and documentation in a timely manner
- • Sign and return required authorization and representation forms
- • Notify us of deadline dates and provide access to your property if needed for inspection
- • Comply with applicable Texas property tax laws and CAD procedures
5. Our Responsibilities
When you engage our services, we commit to:
- • Research and analyze your property's assessed value and comparable market data
- • File your protest with the appropriate CAD before the applicable deadline
- • Prepare a thorough evidence package supporting your case
- • Represent you at all required hearings and negotiations on your behalf
- • Communicate with you throughout the process and keep you informed of progress
6. Limitation of Liability
To the maximum extent permitted by Texas law:
- • LowerMyCommercialTax.com is not liable for indirect, incidental, consequential, or punitive damages
- • Our liability is limited to the amount of fees actually paid to us under our representation agreement
- • We are not responsible for CAD actions, ARB rulings, or judicial decisions outside our control
7. Termination of Services
Either party may terminate our representation agreement at any time with written notice. Upon termination:
- • If termination occurs before a reduction is achieved, you owe us nothing
- • If a reduction has already been achieved, you remain responsible for 30% of first-year savings
- • We will cooperate in transitioning your case to other representation if requested
8. Governing Law and Jurisdiction
These terms of service and our representation agreement are governed by and construed in accordance with the laws of the State of Texas, without regard to its conflicts of law principles. Any legal action or proceeding arising under or relating to these terms shall be brought exclusively in the state or federal courts located in Texas.
9. Service Scope
Mike VanVickle represents commercial property owners in Texas property tax protests. Our services include filing protests, gathering evidence, and representing clients at informal hearings and ARB hearings under Texas Tax Code Chapter 41.
10. Changes to Terms
We may update these terms of service at any time. Your continued use of our website or engagement of our services constitutes acceptance of any updated terms. We will notify you of material changes by email or by posting notice on this page.
